These Terms of Use (the “Terms”) form a legal agreement between you and Break Casino (“Break”, “we”, “us” or “our”) and govern your access to and use of the Break website, online casino platform, games, promotions and related services (together, the “Services”). By creating an account, joining our waitlist, or otherwise using the Services, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old, or the legal age for gambling in your jurisdiction if it is higher, to open an account or play at Break. By using the Services you represent and warrant that you meet this requirement, that you are legally permitted to gamble in your country of residence, and that gambling is not restricted or prohibited by any applicable law that governs you. We reserve the right to request proof of age and identity at any time and to restrict access from jurisdictions in which we are not licensed to operate.

2. Your Account

To play at Break you must register a single personal account and provide accurate, current and complete information. You are responsible for keeping your login details confidential and for all activity that takes place under your account. Each person may hold only one account; duplicate accounts may be closed and any associated bonuses or winnings forfeited. You must notify us immediately if you suspect any unauthorised use of your account.

3. Verification and Compliance

Break is required by its licence and by law to verify the identity of its players. Before you can make certain deposits or withdrawals, we may ask you to complete identity, age, address and source-of-funds checks (“KYC”). We may suspend or limit your account until verification is complete. Providing false, misleading or fraudulent information is a serious breach of these Terms and may result in account closure and reporting to the relevant authorities.

4. Deposits and Withdrawals

Funds deposited into your account are held for the purpose of placing bets and playing games and do not earn interest. You may deposit and withdraw using the payment methods we make available, which may include cryptocurrency. Withdrawals are paid to a verified account or wallet in your name and are subject to successful verification and to any applicable wagering requirements. We may apply minimum and maximum limits and may decline transactions where we reasonably suspect fraud, money laundering or a breach of these Terms.

5. Bonuses and Promotions

Welcome offers, including the advertised welcome package of up to $10,000, and all other bonuses and promotions are subject to their own specific terms, which are published alongside each offer and form part of these Terms. Bonuses may carry wagering requirements, game restrictions, time limits and maximum withdrawal caps. Bonuses are intended for genuine entertainment; any abuse of a promotion, including bonus arbitrage, collusion or the use of multiple accounts, may result in the removal of the bonus and any winnings derived from it.

6. Fair Play and Prohibited Conduct

You agree to use the Services honestly and for your own personal entertainment. You must not:

  • use bots, automated systems, or any software designed to gain an unfair advantage;
  • collude with other players or exploit a fault, loophole or error in the Services;
  • engage in fraud, money laundering, or any other unlawful activity;
  • access the Services from a jurisdiction where doing so is prohibited; or
  • attempt to interfere with, damage or gain unauthorised access to our systems.

Where a game malfunctions or a result is produced in error, we reserve the right to void the affected bets and to correct any related balances.

7. Games and Results

Outcomes at Break are determined by certified random number generators and, for live games, by the play of the table in real time. The result recorded by our systems is the definitive result of any game or bet. Nothing on the Services should be read as a promise or guarantee of winning; all gambling carries the risk of loss.

8. Responsible Gambling

We are committed to keeping gambling safe and enjoyable. A range of tools, including deposit limits, session reminders, time-outs and self-exclusion, will be available within your account. 9. Intellectual Property

All content on the Services, including the Break name, logo, text, graphics, software and game content, is owned by or licensed to Break and is protected by intellectual-property laws. You may use the Services for your own personal, non-commercial enjoyment only and may not copy, reproduce or exploit any part of them without our written permission.

10. Limitation of Liability

The Services are provided on an “as available” basis. To the fullest extent permitted by law, Break is not liable for any indirect or consequential loss, or for any loss arising from interruptions, delays, errors or the unavailability of the Services. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

11. Suspension and Termination

You may close your account at any time by contacting us. We may suspend, restrict or close your account if you breach these Terms, if required by our regulator or by law, or where we reasonably suspect fraud or misuse. Where an account is closed, any legitimate balance remaining, after deduction of amounts properly owed, will be returned to you subject to verification.

12. Complaints and Disputes

If you are unhappy with any aspect of the Services, please contact our support team first so that we can try to put things right. If we cannot resolve your complaint, you may be entitled to refer it to an approved Alternative Dispute Resolution provider or to the Malta Gaming Authority. 13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, our licence conditions, or the law. When we make material changes we will update the “last updated” date above and, where appropriate, notify you. Continuing to use the Services after a change means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of Malta, and any disputes will be subject to the jurisdiction referred to in our licence, without affecting any mandatory consumer-protection rights you have in your country of residence.
